1. Introductory Provisions
1.1. These terms and conditions (the "Terms") govern the mutual rights and obligations between the operator of the Student Websites project (the "Provider") and the person who orders the creation and/or management of a website (the "Client").
1.2. By ordering the service through the studentskeweby.cz website, or by email, phone or other written communication, the Client confirms that they have read these Terms, agree to them and undertake to abide by them. Where the order is placed through the website, consent to the Terms is required by active confirmation (ticking a box) when completing it; the order cannot be completed without this confirmation. Where the order is placed by email, phone or other written form, consent to the Terms is given by the Client confirming the order in that way.
1.3. The Provider reserves the right to change these Terms unilaterally. The Client will be informed of any change by email at least 30 days before it takes effect.
2. Description of the Service
2.1. Within the Student Websites project, the Provider arranges the creation of the Client's website, which may involve a team of selected secondary school and university students under the professional supervision and guidance of experienced industry professionals.
2.2. The creation of the website itself is provided free of charge, including the option for the Client to make a voluntary contribution ("tip") under Article 7 of these Terms.
2.3. The Client pays a monthly fee for hosting and full website management under Article 3 of these Terms.
3. Price and Payment Terms
3.1. The monthly fee for hosting and website management is €29 excl. VAT (the "Fee").
3.2. The Fee includes:
- SSL certificate
- website security
- technical maintenance
- regular system updates
- regular data backups
- website uptime monitoring
- protection against common security threats
- technical support
- small technical fixes
- ongoing oversight of the website's functionality
3.3. The Fee does not include content or design changes beyond small technical fixes – these are governed by Article 6 of these Terms.
3.4. Payment is made on the basis of an issued invoice due within 7 days.
3.5. If the Client is more than 14 days late in paying the Fee, the Provider may suspend the website until the outstanding amount is paid. For the period of delay, the Provider is entitled to a contractual penalty of 0.5% of the outstanding amount for each day of delay, without prejudice to the Provider's right to statutory default interest.
4. Term of Cooperation and Renewal
4.1. By ordering the service, the Client commits to a minimum term of 12 months from the date the website is activated.
4.2. The cooperation automatically renews for a further 12 months unless the Client delivers a written (electronic) notice of termination to the Provider no later than in the last month of the current 12-month period. If no notice is given within this period, the cooperation continues on the same terms for the next period.
4.3. The notice must be sent to the Provider's main email address and must identify the Client and the website.
4.4. If the Client is a consumer and the contract was concluded at a distance (via the website, by email or by phone) or off the Provider's business premises, the Client has the right to withdraw from the contract without giving a reason and without any penalty within 14 days of its conclusion, in accordance with Section 1829 of Act No. 89/2012 Coll., the Czech Civil Code. If the Client expressly requests that the service begin during this 14-day period and acknowledges that they thereby lose the right of withdrawal once the service has been fully provided, the right of withdrawal expires once the service has been fully provided.
5. Termination and What Happens to the Website
5.1. After the cooperation ends (on expiry of the notice period under Article 4, or on withdrawal by either party under these Terms), the Provider stops operating and managing the website.
5.2. The website's domain remains owned/managed by the Client after the cooperation ends. On termination, the Client loses the website itself and the hosting, which remain the property of the Provider. The Client may either: a) buy the website from the Provider for €410, or b) leave the website with the Provider, who may stop using it, modify it or deactivate it.
5.3. The Provider is not liable for loss of website data or content after the cooperation ends unless a buyout under Article 5.2(a) has been agreed.
6. Subsequent Website Changes
6.1. Changes to the website beyond the small technical fixes listed in Article 3.2 (in particular content, design or functional changes) are not part of the Fee and are charged separately according to the scope of work.
6.2. Such changes are carried out exclusively by the Provider's team (not by students) and are invoiced separately, based on an individual quote approved by the Client before work begins.
7. Voluntary Contribution ("Tip")
7.1. During the project, the Client may make a voluntary financial contribution (the "Contribution") to support the Student Websites project and the students involved. The amount of the Contribution is entirely at the Client's discretion, and making it is not a condition for building or managing the website.
7.2. The Contribution is income of the Provider and is used to fund the operation of the project.
8. Rights and Obligations of the Client
8.1. The Client must provide the Provider with all materials (texts, images, logos, etc.) needed to create the website, in the scope and quality necessary for proper performance.
8.2. The Client is responsible for the accuracy and lawfulness of the materials they supply, including compliance with third-party copyrights.
9. Liability and Limitation of Liability
9.1. The Provider undertakes to make reasonable efforts to ensure the availability and security of the website but does not guarantee uninterrupted (100%) availability.
9.2. The Provider is not liable for damage caused by outages of third-party services (e.g. the hosting provider or payment gateway).
9.3. The Provider's total liability for damage is limited to €29.
10. Personal Data Protection
10.1. The processing of the Client's personal data is governed by a separate Privacy Policy prepared in accordance with the GDPR.
11. Final Provisions
11.1. These Terms and the relationship between the Provider and the Client are governed by the laws of the Czech Republic.
11.2. If the Client is a consumer, they may refer any dispute to the Czech Trade Inspection Authority (www.coi.cz) as the body for out-of-court resolution of consumer disputes.
11.3. If any provision of these Terms proves invalid or unenforceable, this does not affect the validity of the remaining provisions.
